Immigration: Leave to remain

We acted for a Client whose further leave to remain was refused based on his private life in the UK and he further challenged the refusal decision by way of appealing the Home Office’s decision. The First-Tier Tribunal held against our Client and the appeal failed. The Home Office’s decision was unfair as our client did not receive any documents from the Home Office. We filed a pre-action protocol letter to the Home Office regarding our Client’s refusal decision and the Home Office reviewed our Client’s application for leave to remain in light of evidence and representations. Further, we sought permission to challenge the decision of the First-tier Tribunal to the Upper Tribunal and permission was granted.

Finally, the Home Office withdrew the original decision and our representations were accepted. Our Client was granted time to find a new sponsor and he was issued a new BRP.
