Suspension of Tier 2 General & ICT Sponsor Licence

We were instructed to assist and represent an Indian Restaurant having branches in the UK & Abroad, against the suspension of its Tier 2 General & Intra Company Transfer (ICT) sponsor licence. The Company held the above-named licences and a compliance visit took place at one of their premises and subsequently another compliance visit in the other branch premises. During the visits, the sponsor licence officers alleged that they had identified several issues which ultimately led them to suspend the sponsor licence and subsequently revoke the licence two months later.

The Sponsor Compliance Unit believed that the job role stated for one of the staff members who was allocated CoS, was not a genuine vacancy and believed his role has been exaggerated in order to facilitate his continued stay in the UK. Due to the evidence provided being undated or not supporting the role the staff member should have been undertaking, the Sponsor compliance unit revoked the company’s licences.

We challenged this decision by way of a pre-action protocol letter and Client’s Tier 2 Sponsor license was fully reinstated. We ensured that the migrant’s Leave to Remain that was curtailed was withdrawn. We also advised our clients on the documents they would need to provide as evidence for the job role being genuine and how to move forward ensuring they are fully compliant.
